Terms of Service

These Terms of Service govern your use of the Simulyn platform and DTAP simulator, operated by SimuLyn OÜ (reg. no. 17395925, VAT EE 102935811), a company registered in Estonia, European Union. Please read these Terms carefully before using our services.
1. Agreement and Parties
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and SimuLyn OÜ, a company registered in Estonia with registration number 17395925 and VAT number EE 102935811, whose registered contact agent is Dalanta OÜ, Pärnu mnt 105, 11312 Tallinn, Estonia ("SimuLyn", "we", "us"). By creating an account on simulyn.io or downloading and using the DTAP simulator, you confirm that you are at least 18 years of age and agree to be bound by these Terms. If you do not agree, you may not use our services.
2. Description of Services
SimuLyn OÜ provides the following services: access to DTAP (Digital Twin Automation Process Simulator), a downloadable industrial training simulator for Windows and macOS; a web platform at simulyn.io for account registration, D Number management, and progress tracking; and, under separate commercial agreements, custom digital twin development services for enterprise clients. The DTAP simulator is a training tool only. It is not intended for use as control software for real industrial systems, and SimuLyn OÜ accepts no liability for any such use.
3. Account Registration and Eligibility
You must be at least 18 years of age to create an account. You must provide accurate, complete, and current information at registration. Each account is for a single named individual unless you hold an active Enterprise subscription. You are responsible for maintaining the confidentiality of your D Number and for all activity that occurs under your account. You must notify us immediately at contact@simulyn.io if you suspect any unauthorized use of your account. SimuLyn OÜ reserves the right to refuse registration or terminate accounts at its sole discretion.
4. D Number and Simulator Access
Upon successful registration, SimuLyn OÜ will generate and assign you a unique D Number in the format D-XXXXX. This D Number is your permanent training identity and is used to authenticate your access to the DTAP simulator. Your D Number is personal and non-transferable. Sharing your D Number with third parties is a violation of these Terms and may result in immediate account suspension. SimuLyn OÜ is not responsible for unauthorized access, data loss, or any other consequences arising from a disclosed D Number.
5. Free Trial
New accounts receive a 10-day free trial with full access to all available DTAP training modules. No payment information is required to activate a free trial. At the end of the 10-day trial period, access to the DTAP simulator will be suspended until a paid subscription is activated. SimuLyn OÜ reserves the right to modify, shorten, or discontinue the free trial offering at any time with reasonable notice.
6. Subscriptions and Pricing
Individual subscriptions are available at €9.99 per month or €95.91 per year (representing a 20% saving over monthly billing). Enterprise subscriptions are available at €250 per month or €2,400 per year (representing a 20% saving over monthly billing). All prices are in euros (EUR) and are inclusive of applicable VAT where required. Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account or by contacting us at contact@simulyn.io. Cancellation takes effect at the end of the current billing period; access continues until that date. 7. Payment Processing
All payments are processed by Stripe, a third-party payment processor. SimuLyn OÜ does not store, process, or have access to your card details at any time. By making a payment you agree to Stripe's terms of service and privacy policy. In the event of a failed payment, we will notify you and provide a grace period before suspending access. SimuLyn OÜ issues invoices in compliance with Estonian and EU VAT regulations.
8. Refund Policy
You may request a full refund within 7 days of your first paid subscription charge, provided you have not completed more than one training module during that period. To request a refund, contact contact@simulyn.io with your D Number, registered email address, and the reason for your request. For annual subscriptions cancelled after the 7-day refund window, we may at our discretion provide a pro-rated refund for the unused portion. Free trial periods are not eligible for refunds as no charge occurs. Perpetual licence payments are non-refundable except where required by applicable law.
9. Permitted Use
You may use DTAP and the Simulyn platform for personal training, professional development, and educational purposes within the scope of your subscription. You must not: share, resell, sublicense, or otherwise distribute access to DTAP or your account; reverse engineer, decompile, disassemble, or extract assets, code, or content from the simulator; attempt to circumvent authentication, rate limiting, or any other security measure; use the platform for any unlawful purpose or in violation of any applicable law or regulation; use automated scripts, bots, or tools to interact with the platform in a manner not intended by SimuLyn OÜ; or represent DTAP training results as official industry certifications unless explicitly stated by SimuLyn OÜ.
10. Intellectual Property
All content within the Simulyn platform and DTAP simulator — including but not limited to 3D simulations, wiring diagrams, PLC logic, training scenarios, educational materials, software, and branding — is the exclusive intellectual property of SimuLyn OÜ and is protected by copyright, trademark, and other applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the platform and simulator for the duration of your active subscription, solely for your own training purposes. This licence does not transfer any ownership rights to you. All rights not expressly granted are reserved by SimuLyn OÜ.
11. Disclaimer of Warranties
DTAP is provided "as is" and "as available" for training and educational purposes only. SimuLyn OÜ makes no warranty, express or implied, that the simulator perfectly replicates any specific manufacturer's hardware, software, or firmware. Skills, knowledge, and competencies developed through DTAP should be validated against real equipment under the supervision of a qualified professional before application in live industrial environments. SimuLyn OÜ expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by applicable law, SimuLyn OÜ and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform or simulator, including but not limited to loss of data, loss of profit, or damage to equipment. SimuLyn OÜ's total aggregate liability for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you to SimuLyn OÜ in the 12 months immediately preceding the event giving rise to the claim.
13. Termination
SimuLyn OÜ reserves the right to suspend or permanently terminate your account without prior notice if you violate these Terms, engage in fraudulent or abusive conduct, or misuse the platform in any way that causes harm to SimuLyn OÜ or its users. Upon termination, your right to access the simulator and platform ceases immediately. You may terminate your account at any time by contacting contact@simulyn.io. Clauses relating to intellectual property, limitation of liability, and governing law survive termination.
14. Amendments to Terms
SimuLyn OÜ reserves the right to amend these Terms at any time. We will notify you of material changes by email to your registered address at least 14 days before the changes take effect. Your continued use of the platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not accept the amended Terms, you must discontinue use of the platform and may request account deletion.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Estonia and applicable European Union law. Any disputes arising from or relating to these Terms or the use of our services shall first be subject to good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the competent courts of Estonia. Nothing in this clause prevents you from exercising your rights as an EU consumer under applicable consumer protection legislation.
